    In Australia it&#39;s a criminal matter, they cant just subponea Isp&#39;s, In Australia they need the federal police to carry out a search warrent on the Isp thus criminality, but with Universitys Riaa is taking them to civil court to try and get names as they wont hand them over.

    Thou this is still untested in Australian courts.


    With movies(not a RIAA matter) it seems they are just issuing warnings.

    what gets me is techniclly it&#39;s not ilegal mp3s a known as data so therefore it is only ilegal to download Metallica songs becaseu they owed the copywight for mp3s

    Downloading data is not Ilegal?

    Seems clear it is not stealing, its copyright infringement.
    They have been offered many alternatives to fix this problem, and refused all.
    They have chosen to turn this into a madhouse, and eventually congress will have to step in, just as they did when they wanted to shut down radio, they implemented Voluntary Collective Licensing. They&#39;ve tried to shut down everthing else from betamax to some fucking piano almost 100 years ago.

    Truth is I picture these guys as being some retarded characters like those on the Sopranos that keep thinking they can win this battle and fuck everyone in their way. Throwing rocks at a tidlewave.

    I guess they figure we all look as such...

    The ISP is just the first in a long leagl process. This is a civil and not a criminal process which means until there is a convection in Civil Court, the party bringing the complaint has to pay all leagle costs (including the battle that providers give when it comes to giving up the names behind the ISPs). As we are really talking mega bucks, befor you panic, you should wait and see how the first court cases turn out. If you are living in Europe (contenial Europe that is) you have no worries at all at the present times. For example in Germany, even when they can trace Kiddie Porn to a specific ISP, they still have to get approval from a Judge to conduct FURTHER investigations against the sicko, and that is for a major Crimal Complaint. So Civil Complaints based on ISP addresses have never been attempted in Germany as yet.

    I heard that a few days ago there were around 500 arrest done to Kazza users. For violating copyright laws. Is this true? Has any one else heard this? I know they can&#39;t possibly arrest every single person. However I think they might be trying to set an example.
    Fuck me, the shit that sum people come out with is amazing....

    My Granny has got more chance of getting Arrested for J-Walking...

    Dude, AOL is a PART of the RIAA. They don&#39;t need to even bother with all this legal bs with them.
