They deleted the entry for today on the wiki page. It said that the servers were taken down today by some antipiracy organization in Germany. I believe is the same one from 2007 just 1 year ago.

As of 19 January 2008 16:00 GMT, Rapidshare's servers where shutdown by anti-piracy in Germany. More than hundreds of rapidshare servers were seized from their offices in Berlin althought no arrestes were made. Sources said, authorities are contemplaiting pursuing legal actions against users who distribute and download pirated copies of software and movies from these servers

They would never be able to sue individuals. There is just too many of them. Besides doesn't Rapidshare sell accounts through paypal? Paypal would have to release everyone's account info then.
Right now I guess they are all rumors. But I don't think it is just a hardware problem personally.

Unfortunately, starting at 5 pm CET, one of our carriers experienced a severe technical problem with their hardware, causing a loss of 50 gigabit of bandwidth. Therefore RapidShare was unavailable for several hours. We already have taken steps to avoid this particular problem in the future.

Their Level3 carrier was out of order - there would have been plenty other carriers to rapidshare, problem was that their name resolution exclusively works with Level3 which meant nobody was able to find their servers. Now with Level3 back up, everything works as usual.
