Thread: No Fear!

    Let me tell you all something right now, No one is in danger of being arrested or being sued for using Kazaa, nor will you ever be. All the stories you might have read recently about people getting busted is a bunch of crap, and I can guarantee you that those who have proclaimed at the top of their lungs that they were sued or arrested were more than likely bought out, by those trying to shut P2P down. Yeah I know that sounds a little farfetched, but lets think about a few things first,

    1. what P2P is all about is stealing, don't try to sugarcoat it, that's what it is.
    1A. But what are you stealing? nothing thats what, it's not like you walked into a store and ran out with a bunch of merchandise. as far as I know theres no law against stealing something thats not tangible.

    2. If by some freak occurence you do get sued, or arrested, or both, no lawyer in the world would pass up your case, the RIAA would have broken so many constitutional laws by doing so that you would literally be able to sue the living crap out of them, even people who keep child pornography on their computers, have sued the hell out of agencies like the F.B.I. and the US marshalls office, they simply have no legal right for doing so.

    What I'm trying to say is, why now all of a sudden are these organizations trying to shut P2P down? why not years ago? Simple, they've run out of options, they have no legal grounds, they're tired of getting ripped off, but they have a snowball's chance in hell of doing anything about it. It's nothing more than a worldwide bluff, they scare you into thinking your going to jail, you stop downloading, but the simple fact is.......They're up shit creek without a paddle, and there's nothing they can do about it.

    exactly i am wondering how do you know this stuff. yes i can see they could of paid of those sued people just to get us scared or it could be the real deal.( i doubt it ) your right to they have nothing to do about just forget about it. besides they ask to much for cd's. kazaa is not going to end up like napster

    I'm in my 2nd year of law school, and by the time I finished with my first year It's as clear as day that there simply is no legal basis for such an action, I was talking about how people who have child porn on their computers and how many of them have sued for people coming into their house, then why do you always hear about people getting arrested for it? because it's more than likely that those who have that kind of crap on their computers, are probably doing it for real too, and they usually are too, so that's why people are always getting busted for it, but this just isn't the same, god it's pathetic.

    I've wondered myself why we never hear about the other side of things..The side from the people the RIAA is supposed to be suing. We never hear about the people being sued taking their lawyers into court with them and fighting this. It always seems when we hear about someone being sued it's as if they turned their bellys up to the RIAA and said Ok you caught me..Take my money!

    I wonder where those stories are. All I've heard lately are a lot of stories about settlements with the RIAA.. WHY?

    Wow, they do make stupid lawyers!

    You come on here and claim the lawsuits are just one big hoax (which the media is going along with just fine) and your only proof is that you don't think they can do that? Your ignorance of the RIAA's legal basis here is astounding for someone who claims to be a law student.

    And who the hell are you? Cochrane? What's this crap your feeding me, about the media going along with the idea that the suits are a hoax? Do you even own a television? The media is having a field day with this whole P2P deal that's true, but not once have you heard or likely will ever hear that they think it's a hoax, be honest, the only time you ever even thought people might think it's a hoax is when you clicked on my post, I suggest you study up a bit more, I already have, and I'm still not convinced legally, or personally that they can do anything about it, and while were on it did you see one time in my post a place where I said, that I "think" they can't do that? No, I came right out and told you they couldn't. Don't blast me, claiming I'm ignorant, when you yourself has no idea what's going on. And if your so educated on the subject, please.....enlighten me.

    um.. you're kidding right- a copyrighted song is not tangible - do you think it has to be on a cd to be covered by copyright law? anyways i'm not wasting my time on a discussion of this nature but i got a kick out of your post... thanks

    If you really were a law student, second year nonetheless, you'd know the difference between theft and copyright infringement. And how intellectual property ties into all of it.
