    The highest court in the Netherlands has sentenced that KaZaa is a legal peer to peer program in the Netherlands and can not be hold responsable for illegal activities of individual users of the program. Downloading music for other than own use is, and always has been, punishable by law.

    Welcome and thanks for the heads up.

    However as some of my erstwhile colleagues have suggested, it was always taken as a given that the program, in and of itself was not "illegal". It was only the use of it to breach copyright which was considered an offence.

    For clarification, in the UK, it is not permissible to breach copyright, whether for own use or not. You are not even allowed to make a copy of something you have bought. There is no legal provision for reasonable use. No copies allowed, that is it.

    The big issue in the UK is that, if you download or copy for own use then it will be treated as a civil matter. In short you will be sued by the copyright owner or their representative. If you mass produce for gain, then it will probably be dealt with as a criminal matter. The final decision will not be for the copyright holder to make, it will be for the Police and then the relevant prosecuting body, depending on the jurisdiction.

    In Scotland it is practically impossible to be prosecuted for this type of offence. Civil proceedings are however another matter, though how they would gather the evidence required escapes me. Any suggestions gratefully received (seriously).
