My ipod is dead!!!

I just did an update on the Ipod 20gig 2.1 i think and now and restarted comp, and removed ipod the way it need to be removed and now my ipod is showing my this exclimation icon warning... and my ipod doesn't work no more.... I need help is there a way around this or my ipod is dead.????


can i sue apple for this ????

Some part in it (hard drive) probably failed.
I'd return it if it's new, or contact apple.
