I have to say, that I did't have a problem until now in Germany and I'm downloading a lot from open trackers found over www.torrentz.com. But even if there are chances to get cought, the punishment is still very low.
What I heard (I'm not a specialist in law) is, that you'll only have to pay under 100 Euro, so just go ahead and download
