sounds like good intentions... but, yeah, it's prolly not going to do a whole lot of good, if we go by the previous example of the CAN SPAM law. people who are doing outright illegal stuff will just go further underground, and there'll prolly be a legal loophole or two.
it's much more realistic for operating system publishers (microsoft, apple, linux companies) and ISPs to block the transmission of such things, in the same way that they try to block spam and popup ads, since they have direct access to the nuts & bolts. the anti-spyware law might come in useful though, for allowing those companies to sue people who repeatedly find ways around spyware-blocking.
