I guess I could ask for a death certificate. Though it may take a while since it would have to come from San Diego.

I think it's more just that my ex-boss is a fucking bitch who doesn't understand that when someone's immediate family dies suddenly, it's not like a bloody goldfish.

They can not fire you for missing one day (with a good excuse), did you call it in before hand or just not show up? Ofcourse if your a pilot it can be annoying.
There must have been more to lead this on, no?

Anyway there are more and better jobs outhere.
Feel bad for for you.

I left her a note, since I'm asleep when she's awake. I'd been working there three years and never had anything written up against me.

I'd get drunk, but I'm short on booze and probably shouldn't go out and buy a whole wack of it. So I guess stoned will have to do.

Nope...no union. :( I'll probably end up going before the Ministry of Labour though, and filing a complaint and that.

Go for it MagicNakor, hope you get it sorted,
In the UK if you have been Dismissed, it has to be for good reason and if the employer is found guilty then they have to offer the job back and give compensation, but you don't have to go back to that job.

/me regains composure.

Surely with no warnings for five years and the note you left, you've a pretty watertight case for getting your job back.

Before you go to the expense of legal representation, see your boss and explain that you intend to contend the dismissal and that you've been led to believe that your appeal will be successful. If I was your boss, I'd realise this and may offer to rescind the dismissal and issue a written warning in its stead.

I'm a strong believer in unions, and I always have been, I advise any worker to join, it's in your interests to do so.
I'm with one of the biggest unions in the UK, CWU & a member of UNITE.
They kick ass for a small membership fee :D

Maybe so but there's a lot of small business that doesn't have the union option available.

@MagicNakor, this situation is truly wrong. I think that making a complaint would be a good idea. Not to get the job back (it's not good to work for people like that), but for personal satisfaction and to tell them that it's not right.

In fact... I really think that people should be allowed to take the occasional day off whenever they choose to. They don't own you.

@ Virtualbody1234,
In the UK, almost every employment occupation will have a union you can join, it's nice to have an independent body looking after your interests.
And in this case it would have been a wise choice to seek advice from a union.
That’s if you have Unions in Canada dude!

Sounds awfully like unfair dismissal to me. Given the circumstances, your length of employment, your good record you could probably get a decent wedge out of them. Consider this;

1. Under the circumstances it sounds like they were looking for an excuse. Who would sack someone for such a thing. Maybe they're closing an office, outsourcing their satanic practices, think you're a cawk. Whatever

2. That being the case, do you really want to go back. You'll have it hanging over you. Not just the dismissal, but the fact you will have annoyed your gaffer. They'll love you for that, like.

3. Aren't American Lawyers really into the no-win, no-fee thang. It might be worth talking to one and seeing if you have a claim for unfair dismissal (or whatever you call it). Sue the arse off of them, that's my advice.

4. Please remember you have found this whole thing very stressful, particularly as it comes on top of a bereavement. That should up the ante a bit.

5% would be nice when you get your settlement. I'm not greedy.

Please also accept my condolences for your loss.

Must go, I think I heard an ambulance

Bosses can be bastards! Fact.

Go for the jugular and sue them hard. At least whilst looking for another job you will have time to sort out the necessary paperwork.

If you have any snotty or disrespectful emails from your ex-boss, that can also help your case as you can say you were being picked on.

I've been in a similar situation and kept my job, new contract and a pay off at the end of it.

Although I have now been out of work for 2 months so it hasn't helped long term unfortunately.

The trick is that when you get a job like that...back, you immediately (even beforehand) look for a new one.

MagicNakor

I won't be suing them.... the lawyer says it's far too expensive for the outcome (which would be the job offered back to me, which I wouldn't end up taking anyway). Apparently the best thing to do is get a letter from the doctor explaining how the stress came into play, and then use it for EI (speeds up the process/grants more) and future employers (since obviously I won't be getting a reference). Kinda sucks, but it's not a very litigious country in that respect.
