Got a premium account a few days ago and I have to say it is awesome. Much better then BT, even private trackers.

But how come they are still around all this time? They claim they are not responsible for any copyright violation since they are merely hosting the files, the users are the ones uploading them. Napster lost a court case using a similar defense.

How long do you think they will last? It seems almost certain they will get sued, so what is their incentive to keep growing?

They've got the money in their pockets don't worry, they are the best,
they can't get sued, because they are not responsible for what people upload and download, and their site/servers is totally legit :D and they do remove your files when people/MPAA-RIAA snitches on links...
And you can't compare them with napster...:noes:

that statement above doesn't mean the riaa can't sue them in fact not suprised they are on to shutting them down , they are no different from other sharing networks such as usenet and bit torrent .

BitTorrent will be much more difficult to sue since none of the tracker sites are actually hosting the files.

This is not true for Usenet and RapidShare. I give RS six months tops before they will be all over them :frusty:.

I could just be pessimistic as usual though.

Rapidshare are no different to any other webhost. If they comply with take down requests nothing will happen.

they usually remove the files that are complained about, then users can still upload them under a different name though :)

Yes I believe they will get sued if they draw to much attention the RIAA or similar will get pissed off because the music industrie is looseing a couple bucs here and there. The RIAA has great political influence and they are able to bend the copyright laws in there favor. Trust me they will find a way.

RS is up since more than 3yrs..

Besides... Its just a file hosting service like Yousendit or Mediashare.. etc..

There is no way it can shut down...i am damn sure abt that..

Never mind Rapidshare, see what they are doing in France !

ISP's will have to disconnect users who do much downloading !

That will stop the whole thing it its tracks !

I have been suggesting the same thing to stop Spammers !

But What you are forgettin, Oink was linking to files to download and you could search files on that "Private Tracker",
Oink was dedicated to music file sharing and was known to all, But compare to RS, it's a file hosting site that is only dedicated to private personal file hosting, and they don't have no search feature included in RS, and they are complying with the law and shit, so they will never get into trouble, believe me, they know what they are doing,
Don't forget people also host legal stuff on RS, like homework,
documents, and stuff...

If they wanna prosecute RS in a court of law it will be much more difficult than it was on Oink, coz RS is legal for now :D

Read ^^ :01:

Which UPLOAD RULES have to be followed? (Terms of use)

No files with illegal contents, for example pornography, child pornography, racist material and/or unauthorized copies of copyrighted material. This statement of categories is not the completed list.
We will not tolerate any abuse of our servers for copyright violations and reserve the right to delete any file that has been uploaded and/or distributed in violation of German or international copyrights. Copyright protected content may especially not be distributed to third parties (for example by publishing links to copyright protected files on other websites).
We will therefore delete any copyright protected file that we find on Internet Forums, warez-sites, etc.

I don't think Oink had that kind of Rules ?:shifty:

The only problem that RS could possibly have someday, but that won't so sure, it's that ISP's actually block access to their users to RS, but even that it won't stop RS :naughty:
Coz you can still change ISP and go for another one...

Music Industry is loosing alot more then a couple of bucks but don't feel sorry for them. They need a new model and system so artists can get their proper due.

Not only they have money, but also as soon as they get any message from any company they delete the files the company was reffering to.
