I don't think anyone has posted this, but I think it's a good refresher.

Check out line # 51 where it says:
The DMCA (Digital Millenium Copyright Act) does not authorize the issuance of subpoenas or DMCA notices to a service provider such as PBIS based on services its provides when performing the "conduit" functions described in 17 U.S.C & 512 (a).
But it gets better:
Line # 52 says: No other provision of law authorizes the issuance of these subpoenas.
But I really love this one:
Line #63 says:
Issuance and enforcement of a subpeona seeking information identifying the customers of a service provider such as PBIS violates the rights guaranteed to PBIS subscribers by the First Amendment and the Due Process Clause of the Fifth Amendment of the United States Constitution.
