[quote]Furthermore, information suggests that the police will be arresting and interviewing more users in the course of this investigation but at this stage it is unclear exactly who they are targeting and why. A one-off album uploader seems an unlikely target, particularly as legally in the UK, the fact that the album was allegedly pre-released - as opposed to released after retail - means little.[/quote

they didn't have any info on who was seeding what. all of the personal data on the server was in the ram so the second the server was raided everything disappeared and can not be retrieved.

if they arrested someone who might have been an oink user then they are arresting that person on some other charge as well.

oink is going to win the court case. if he wasn't then why would they keep delaying his court date? it is a fear and propaganda game they play. The longer they hold the court date then when oink wins the less the news will cover his win and all most people will see is him being arrested without knowing the outcome.

The guy just uploaded (shared) an album. He did not make any profit whatsoever from the act. He was just sharing his music with a friend, from across the world. Or many more fiends. He bought the album or someone else did. Same difference, no one stole anything.
Greed, this is what it's all about. These companies just want more...

I guess the police don't have anything more important to do, such as investigate violent crime. Must be a Utopian society over there in the UK.

I'm not worried.

Why?

1. He was the original uploader of a pre-release album. (I've never uploaded anything personally there)
2. Site logs can be manipulated. Prove they weren't. Burden of proof is on the prosecution.
3. The laws (where this person lives) are written for people who make a profit (commercial gain). He made none.

This case will probably be thrown out anyway due to #3.

sounds like a poorly thought out publicity stunt by UK police

The laws aren't perfect, and this is the perfect example of it. Being arrested just for sharing an album and making no profit off it? That's just wrong. But in the end their efforts are in vain, since piracy will never cease to exist no matter what the anti-piracy organizations do.

there's no source or proof of any of this happening, other than torrentfreak reporting it. don't forget this website is prone to sensationalism.

until there's a statement by someone offical, I wouldn't believe a word of it.

No one is getting arrested. Its all scare tactics people. The police will proberly say that they arrested another 10 or 20 individuals who were uploading files just to scare the rest of the pirates off. With out proof they cant do anything.

Remember the police had to catch Alan Ellis whilst he was browsing OiNK just so that they have enough evidence to arrest the guy and take him to court. They cant just bust down your home door without without having any concrete evidence.

Clearly it's a scare tactic. Like coder said they've really got nothing on him. Any decent lawyer would hopefully be able to get you off any criminal charges. More worrying is the fact that police appear happy to act as an enforcement arm for the record industry. When there's no crime to charge you with but the police feel free to bust your arse that's a scary situation. Though i guess there's nothing really new in that. 1984 here we come :\

Torrentfreak didn't even cite its source. Until it makes a proper news site I have no doubt it's a load of bullshit. Unless it was to do with pre releases it is a CIVIL matter, the police have no power to charge you with anything.

they would have a much harder time trying to prove criminal intent than they would in civil matters... i would think in a criminal case the defense could prove it is possible for log tampering, hence reasonable doubt... where as a civil suit it doesn't matter as long as the possiblity is there... so, its just a big watse of time if they are actually doing that..

so in otherwords... their efforts (if really true) will equal a major failure.... lmao

Seems it is true, the story is linked on oink.cd website. I'd take any possible pre cautions if your in the Uk and upped any pre releases. Wondering if uploaders in other countries with strict anti piracy laws might be at risks as well. Not sure how it works, but I assume seeing as the Uk collaborated with the Netherlands to raid the servers then it's possible, although surely unfeasible for the extent of the crime.

Cleveland is a County in the UK, like Northumberland, Yorkshire, Buckinghamshire etc etc.

Middlesborough is probably the best known City/Town in Cleveland, But there is Redcar where the Atonement film was shot (or at least parts of it).

British Police Confirm Six OiNK Users Arrested
Written by enigmax on June 02, 2008
British Police have just confirmed that several users of BitTorrent site OiNK were arrested recently. TorrentFreak broke the news last Friday after sitting on the story for a while but the mainstream press have been holding back over the weekend, waiting for confirmation. Just seconds ago, confirmation came.

Last week TorrentFreak reported that Cleveland Police had arrested a user of OiNK, who was questioned and later released on police bail.

We also discovered that other people had been arrested and deduced from our sources that this police action was taken against alleged pre-release uploaders - those that share before the retail date.

A few minutes ago in an email to TorrentFreak, Cleveland Police confirmed that a total of six individuals were arrested, all in connection with the uploading of pre-release music.

Three of the arrests were made on Friday 23rd May and three more on Wednesday 28th May. The arrested individuals are five men aged between 19 and 33, and a 28-year-old woman.

Suspects were taken to their local police station for questioning and required to provide DNA samples and fingerprints. According to our sources, they were arrested on suspicion of “Conspiracy to Defraud the Music Industry” although this hasn’t yet been confirmed by the police.

We can confirm that at least two of the arrests are for the alleged uploading of a single album. All have been bailed pending further enquiries.

Update: The Register contacted the BPI who gave this statement:

The BPI and IFPI worked with the police in order to close down the OiNK tracker site last October. The illegal online distribution of music, particularly pre-release, is hugely damaging, and as OiNK was the biggest source for pre-releases at the time we moved to shut it down. We provided the information to assist this investigation, but this is now a police matter and we are unable to comment further at this stage.
