View Full Version : How safe is it in Germany?

Hi,

just moved to Germany from China.
I didn't really give a rat's ass what I was downloading in China but it's a bit different here in Germany. Some guy in my class even received a letter from some law firm, something about a 5000 Euro fine. He solved in the end by hiring a lawyer, etc.

Anyways, long story short:
Can I safely torrent in Germany?
I'm using a private torrent site atm. Some people told me downloading is fine just as long as I don't download anything. Any truth to that?

definitely true. don't download and you're safe.

seriously: avoid public trackers and everything is cool.

Oops, what I meant was:
As long as I don't [b]upload[/v], dowloading is fine.
So getting stuff from piratebay is safe as long as I don't upload anything?
Can I upload to private trackers?

nothing is safe. the chances of being caught on a private tracker are just smaller.

if you use private trackers you'll have to upload.

Depends what you mean by "uploading".

You mean uploading as in sharing the files back, or uploading as in putting .torrent files up on the trackers in question?

General advice, take the usual precautions, i.e. public trackers are aids, stay away from them, etc.

Oops, what I meant was:We know what you meant. It's a plague, because by this they simply mean LEECHING.
To tell you this, it's also illegal to "only" download copyrighted material.

ThePirateBay is not in the main focus of where they're looking here, but you never know.

If you don't download local stuff it's better, if you use private tracker it's better.
For new german files, you could use Rapidshare like many germans do as well.

Nothing is safe :cry:. Seed boxes are encouraged amongst Private Trackers however.

Apart from The Netherlands and Afghanistan what countries is it legal to download :naughty:.

Avoid Public Trackers - they are a heaven for anti-piracy organizations.

I have to say, that I did't have a problem until now in Germany and I'm downloading a lot from open trackers found over www.torrentz.com (http://www.torrentz.com). But even if there are chances to get cought, the punishment is still very low.
What I heard (I'm not a specialist in law) is, that you'll only have to pay under 100 Euro, so just go ahead and download ;)

for 100 € a lawyer wouldn't even pick up the phone. fines are much higher when you get caught. expect thousands of euro.

I might be wrong with my interpretation but §97 UrhG (Copyright Law) says that if you get cought the first time, the aggrieved party has the right to a replacement for their loss. The value of the loss is calculated by how much profit the owner has lost due to the violation of the offender. That should not be that bad as a Movie/Game etc. isn't so expensive.
In §97a it further says, that the amount that you have to pay for the work of the lawyer of the aggrieved party is 100 Euro.

All in all that doesn't sound that bad, does it? But it only applies to the first time you get cought, as an injunktion will forbid you from doing it again.

As I do not have any experiences with the interpretation of laws I migth surely be wrong but I really would very much like to know what will expect me if the time comes :dabs:

The 100 € cap is not valid for "a complete album" or a "new movie".
Also you might trigger many copyright violations without knowing it - the bill might come months after that.
