" Friday, Britain (http://www.ecommerce-journal.com/tags/britain)'s High Court (http://www.ecommerce-journal.com/tags/court) declined the autistic British (http://www.ecommerce-journal.com/tags/british) man's appeal not to be extradited to the US (http://www.ecommerce-journal.com/tags/us) to face trial (http://www.ecommerce-journal.com/tags/trial) for hacking (http://www.ecommerce-journal.com/tags/hacking) into military computers (http://www.ecommerce-journal.com/tags/computers). The Court ruled that Gary McKinnon (http://www.ecommerce-journal.com/tags/mckinnon) should face the extradition (http://www.ecommerce-journal.com/tags/extradition), moreover Judge (http://www.ecommerce-journal.com/tags/judge) Stanley Burnton said in his 41-page ruling (http://www.ecommerce-journal.com/tags/ruling) that extradition was "a lawful and proportionate response to his offending." He also said the case (http://www.ecommerce-journal.com/tags/case) should be dealt with "as expeditiously as possible," and McKinnon could be extradited by September.
Previously, McKinnon was fighting a long legal battle to avoid extradition to the US after he was charged with breaking into 97 computers belonging to NASA (http://www.ecommerce-journal.com/tags/nasa), the US Department of Defense and several US military (http://www.ecommerce-journal.com/tags/us_military) branches soon after the terrorist attacks, September, 11, 2001. In order (http://www.ecommerce-journal.com/tags/order) to avoid facing a US trial, McKinnon offered to plead guilty to a criminal (http://www.ecommerce-journal.com/tags/criminal) charge (http://www.ecommerce-journal.com/tags/charge) in Britain earlier this year.
McKinnon's lawyers and 40 lawmakers have written applications (http://www.ecommerce-journal.com/tags/applications) to President (http://www.ecommerce-journal.com/tags/president) Barack Obama (http://www.ecommerce-journal.com/tags/barack_obama) trying to get permission (http://www.ecommerce-journal.com/glossary#term6949) not to be extradited.
McKinnon's family and supporters are trying to prevent the extradition, claiming convict has Asperger's syndrome, a form of autism, so he could be at risk (http://www.ecommerce-journal.com/tags/risk) of psychosis or suicide (http://www.ecommerce-journal.com/tags/suicide) being sent to the US.
The Crown Prosecution (http://www.ecommerce-journal.com/tags/prosecution) Service (http://www.ecommerce-journal.com/tags/service) ruled, however, that the case was best prosecuted in the US, leading his attorney (http://www.ecommerce-journal.com/tags/attorney) Edward Fitzgerald to argue that the service had failed to take account (http://www.ecommerce-journal.com/tags/account) of humanitarian factors.
