A forthcoming copyright bill backed by key U.S. senators would place file swappers in prison for up to three years if they have a copy of even one prerelease movie in their shared folders.

In addition to the prison term, the Artists' Rights and Theft Prevention Act would punish making such movies available on a public "computer network" as a federal felony with a fine of up to $250,000. It would not require that any copyright infringement actually take place.

Hollywood studios have fretted for years about Internet distribution of prerelease movies, meaning films that have not appeared on DVD or in theaters. Footage of "Star Wars: Episode II," "Tomb Raider" and "The Hulk," has reportedly surfaced on peer-to-peer networks before their commercial distribution. In September, the major studios responded by halting their normal practice of sending DVD "screeners" to Academy Award judges.

A copy of the bill seen by CNET News.com, marked "Discussion Draft," represents one of the fiercest attacks yet on peer-to-peer networks from copyright holders' allies on Capitol Hill.

The threat of a three-year prison term kicks in when anyone makes an illicit copy of a movie "available on a computer network accessible to members of the public," when the film "was intended for commercial distribution but had not been so distributed at the time." Once the film is commercially distributed, the felony penalties appear to no longer apply.

well if they were smart, which i am pretty sure they are not

they would've release them in irc channels, newsgroups, bittorrent, and NOT fasttrack network. if you want movies that doesn't play, music that screeches, games that dont play, apps that dont work then sure go ahead use kazaa

Apparently their not centering on who released them but anyone that is even in possession of copies of prereleases. You mean to tell me youve never had a said file in your possession?

And what does this have to do with just kazaa? If you have the file and are caught with it befor release, your goin down.

Extradition is only applicable if the crime is also illegal in the country your being extradited from.

In other words...the USA can go screw itself, Canada wont extradite for it :P

It&#39;s illegal to share pre-releases of movies even in Canada unless you have permission from the makers. Mind you, it&#39;s not a felony (or equivalent), but it is illegal.

You can think of them as having NOT entered &#39;public domain&#39; (where the general public can see them) yet.

Hey, im an American but I gotta say I think he&#39;s right...

For one thing, I don&#39;t think they&#39;d be able to extradite you legally if you live in Canada for that sort of thing. The kind of thing we&#39;re talking about isn&#39;t really even illegal in Canada (completely illegal,that is..) Besides, American law (especially such trivial law) has no jurisdiction over the borders...

Secondly, I don&#39;t think even if they could, I don&#39;t think they would. What a godamn waste of time that would be&#33;

If they started messin with those canadians, I&#39;d fuckin throw a riot. It&#39;s bad enough the RIAA and MPAA do what they do to us

Why does everyone have a go at Canadians? :( They&#39;ve got some beautiful places in their country and i&#39;ve known a few Canadians and they&#39;ve all be friendly toward&#39;s me and have a good sense of humour :)

wat i&#39;m really annoyed about is y the americans&#39; think canadians suck. we have the best gov provided services in the world. toronto is rated the best city to live in, and canada has like almost 0 crime rate. evil blind americans

What would happen if a million file sharers went in to their local police stations and turned themselves in? The courts would be clogged for decades&#33;

They don&#39;t have much money to waste. The owners of Kazaa make 175 times as much as the highest paid member of the RIAA. They&#39;re just using another scare tactic with another bill that won&#39;t pass. We can always count on the Republicans to shoot down any anti-piracy bill, it&#39;s called Smithian economics.

Not trying to argue here, although the internet did originate in the US by your DoD, the computer didn&#39;t, the original computer as we know it was the UTM, Universal Turing Machine, inventing by Alan Turing while studying for his PhD, in 1936 I think, who was English.

dude. i lived in toronto for 4 years. i would know. plus, i remember we had a police officer come to our school to talk about drug awarness, and he said that vancouver had the most drugs and drug dealing
