The reason it's given 'critical' status is so Windows' auto-update feature will offer it for download to everyone who has it configured to run because it doesn't offer standard Windows feature updates like WMP etc.
This way, M$ are reducing the likelihood of someone accidentally discovering the symbol and taking them to court under the pretence that they have been harmed by seeing it, just as Janet & Justin are apparently facing litigation from a woman who witnessed 'nipplegate'.
