Kazaa isn't illegal, when the RIAA went to court the ruling was the application wasn't illegal even if some activity on it maybe.

Kazaa Media Desktop (KMD) itself is a perfectly legal program. Kazaa Lite (K-Lite) on the other hand is a cracked or modified version of the original KMD. Now, according to the KMD license agreement, any modification of the original KMD executable is illegal and against the law. That makes K-Lite absolutely illegal.
But, till date Sharman has taken little steps to block illegal "Lite" distributions of the Kazaa Media Desktop. That is why you see so many websites on the internet serving "Lite" versions of KMD. Grokster, on the other hand has taken severe measures to uproot any websites that server "Clean" or "Lite" versions of the original Grokster. Hence you will find very few websites that actually host "Clean" versions of Grokster.
