why do they make off the road vehicles when it is against the law to drive 'off the road'. (UK)

At what point was it against the law to drive off-road in the UK? All land is either private or owned by gov but with permission one way or the other then off-road is very available (did nice one myself up north in a land rover sport, not my car (couldn`t afford it) but a great day)
If going into a war (and I limit the choice here) who would you trust more to have your back the Italians or the French?

Section 59 of the Police Reform Act applies to two specific off-road offences.
1. Careless or inconsiderate riding/driving on a public road or place.
and
2. Riding or driving unlawfully on land not forming part of a road, such as common land, moorland, footpath, bridleway.
