Law and order is a devolved issue. The Scottish Executive make the law in Scotland. The Lord Advocate decides on how prosecutions should be decided upon and progressed. He does this thro' the Crown Office and Regional Procurators Fiscal.
This is all totally independent of the UK Government. Even before the matter was totally devolved we had a seperate legal System, with the Lord Advocate in charge of all criminal prosecutions.
Trust me non-commercial filesharing is not a criminal matter in Scotland. Stealing is.

If I thought filesharing was stealing, in the eyes of God, I would not do it.
The other stuff is to illustrate that neither is it a criminal matter, in my country.
