Try this:

control panel > phone and modem > modems > properties > advanced > advanced port settings....move the sliders all the way up/

Also:

control panel > phone and modem > modems > properties > modem > set your maximum port speed at the highest setting.

Remember, being on 56k you can also just be having a lousy connection day, I get those too.

Unfortunately all those settings were already set to there highest :( would defraging it help?

Defraging might do it. (I should've thought of that.) I suggest Perfect Disk, the best defrager imo. You can find it on Kazaa I'm sure. But just use the Windows one for now.
