U.S. House Passes Anti-Spyware Bill
The bipartisan Internet Spyware (I-SPY) Prevention Act of 2004, passed by a vote of 415-0, is intended to punish spyware without placing undue burdens on legitimate uses of the same or similar technology. The bill, H.R. 4661, was sponsored by Reps. Bob Goodlatte (R-Va.), Zoe Lofgren (D-Calif.) and Lamar Smith (R-Texas).
The new law would make a number of spyware spreaders' actions illegal. Those actions include accessing a computer without authorization or intentionally exceeding authorized access.
In addition, the law would make it a crime to cause computer code or programs to be copied onto a computer to further another federal offense; to perform identity theft; or to impair the security protections of the computer. Penalties for breaking the law would run from two to five years in prison, in addition to fines.
In addition to the penalties, the I-SPY bill allocates $10 million to the Department of Justice to combat spyware and phishing scams. "We need strong sanctions," Goodlatte said in describing the penalties.

Great!Now I don't think this will bring about an end to spyware but it is a start

sounds like good intentions... but, yeah, it's prolly not going to do a whole lot of good, if we go by the previous example of the CAN SPAM law. people who are doing outright illegal stuff will just go further underground, and there'll prolly be a legal loophole or two.
it's much more realistic for operating system publishers (microsoft, apple, linux companies) and ISPs to block the transmission of such things, in the same way that they try to block spam and popup ads, since they have direct access to the nuts & bolts. the anti-spyware law might come in useful though, for allowing those companies to sue people who repeatedly find ways around spyware-blocking.

It should eliminate the spyware from retail software or websites, shouldn't it?
I guess software does have a software agreement that you must agree to.

Is the bill specific about what is spyware?. Look at the arguements with companies having their products blocked by spy blocking programs citing that they are adware not spyware.
The software agreement for shareware for example...is that covered in the bill or does it just cover malicious attacks?
Are cookies included ?
