I don't think this suit will work, they acknowledge the general use of the server, yet are going to attack it as if they operate specifically. This means they understand their own contradiction, and are just swinging anyway.
I've used hotfile to upload my school files back and forth, it has been the least obstructive free service so far (that I've used). The litigators are focusing on profiting from copyright material, but at the fundamental level they just provide server speed and space for payment, something that costs money. It's not like they categorize their site. One could simply make the case for the "creativity of its users"
