Season 3 isn't over yet. It's just taking a mid-season hiatus. It's divided into volumes 3 and 4.
Volume 4 will start mid-February and run for another 13 episodes or something.

Is season 3 finished or not ?. A season can't be divided in 2 seasons. Eiter it's season 3 or it's season 4.

TV seasons take breaks all the time, especially when Christmas dictates the divide. It happens regularly in tv channels when there are sporting events, political events and anything else the network deems important enough to suspend the season. So, you're wrong, I'm afraid. Season 3 will continue mid-Feb with Volume 4. Season 4 won't start until next November, if indeed it starts at all, seeing as Heroes has become pure wank. Its future hangs in the balance.
