Thread: Complaint In Pacific Bell V. Riaa Case In .pdf

  1. #1
I don't think anyone has posted this, but I think it's a good refresher.

Here's the whole PDF file of Pacific Bell Internet Services PBIS (an SBC affiliatte) Vs RIAA, Mediaforce and Titan.

    http://www.eff.org/IP/P2P/PacBell_v_RIAA.pdf

This is public information by the way, I saw it at EFF.org

Check out line # 51 where it says:
The DMCA (Digital Millenium Copyright Act) does not authorize the issuance of subpoenas or DMCA notices to a service provider such as PBIS based on services its provides when performing the "conduit" functions described in 17 U.S.C & 512 (a).

    But it gets better:
Line # 52 says: No other provision of law authorizes the issuance of these subpoenas.

But I really love this one:

    Line #63 says:
Issuance and enforcement of a subpeona seeking information identifying the customers of a service provider such as PBIS violates the rights guaranteed to PBIS subscribers by the First Amendment and the Due Process Clause of the Fifth Amendment of the United States Constitution.

Any way I'll let you read the rest.

I'LL BE HONEST I HAVE CABLE RIGHT NOW BUT I'M CALLING THEM TOMORROW TO CANCEL AND I'M GOING WITH PBIS or SBC/Yahoo FOR MY ISP, AT LEAST THEY ARE THE ONLY COMPANY THAT'S PROTECTING IT'S own CONSUMER. I RATHER MAKE THEM RICH, THAN MAKING THE RIAA RICH.

    PEACE, HOPE YOU ENJOY
OH YEAH, AND FOR THOSE RIAA SPIES THAT ARE IN THE FORUM, DITTO.

The RIAA (Titan) Is a purveyer of pornography? That's disgusting.
Why does it not surprise me that these little details are emerging ( and will continue to).
Pornographers taking American youth to task for sharing wth their friends. I wonder, could the motive here be somewhat ulterior? There is a substantial amount of pornography traded on kazaa after all......

LMAO- It's almost as if people might think that the music recording industry was sinful.

Does this mean that people have changed (more perverted)? I feel that people have been this way thu out history (and I do consider myself a Christian). Why should anyone be surprised by the fact that people view free porn via Kazaa??
