Thread: Stop Malicious, Fake And Mislabled Files

    After thought, I decided to send this email to Sharman Networks...
    Considering The Fast Track Network is under attack via many things such as Malicious, Fake, and Mislabled Files amongst other issues such as the Spooks monitoring the Network, it seems the Networks days may be numbered if nothing changes, it is time to address the issues at hand and make changes soon.

    Perhaps Sharman Networks could add a clause in their terms of use...

    Terms And Conditions Of Use.

    Those that install the Kazaa Media Desktop or any version thereof which is licenced to Sharman Networks with the intention of supplying Malicious, Fake or Mislabled files in numbers with the intention to harm other users or deface the network will be held liable for damges due to the loss of revenue due to any subscriber base loss, also to incude, but not limited to, court costs , attorneys fees, and punitive damages. In addition any conduct of this sort will make liable those who do so for any other losses of any sort. In addition, Sharman Network reserves the right to monitor any said action on the network, and will extract IP's from those serving such material with the intention to harm. Furtermore Sharman Networks also reserves the right to bring forth appropriate court action against those who deface or harm the Network or the subscribers which use it.

    Truth is if the company was under my wing, I would have put this in the Terms Of Use at the first site of all this, if nothing else it could at least give a decent countersuit or some leverage along the way.

    Seems to me those dimwits are kinda sittin' on their asses wathing the villagers go on a witch hunt while they merely stand by, not realising they are the witch about to baked and tossed into the river.

    Perhaps they are content with their new point system they have f**ked into KMD 2.5, or maybe they intend to lay down like a beat rat awaiting defeat, perhaps they are ready to retire with all the the riches they have made as well.

    How do you watch greatness shrivell to shit when it is your own?

    I just find their stance almost as pathetic as those attacking them.

    Yes I think it would have been a good idea for them to add that clause. Nobody should be allowed to harm this network.

    This idea might be worth pursuing, but probably needs careful consideration. It doesn't seem that the strongest position would be based on "fakes", since the "real" files are the subject of quite a controversy when it comes to "sharing".

    As a start, let's agree that the copyright owners have a different view of the legality of this network's reason for existing. Their argument is that no "real" files should be transmitted, just defending their property rights, etc.

    What might be a more attractive insert into the terms of use could make a distinction by labelling certain types of files as containing interference or other contaminants.

    Specifically, if someone knew the methods used - in a generic sense - to corrupt these files, then it might be possible to obtain an agreement of consent not to distribute files bearing such corruption. For instance, if the corruption could be nailed down as owing to a certain bit of "code" then a term of use could forbid (knowingly) uploading any file containing that code. The trouble would be finding an appropriate definition of the code that would be sufficiently wide in scope to prevent the evil-doers from regigging it a bit and staying outside the boundaries of the agreement (think designer drugs).

    But if such a definition could be found, I'd say put the term in along with a "liquidated damages" clause. This eases the whole court thing a bit, should it come to that, because the parties have agreed to an amount of damages within the contract itself. A big number could convince RIAA it has a lot to lose by sabotage.

    Waddaya think about that?
