Partial files are shared, so each person may only provide some of the file. Tho' sometimes there is only one source. Is that not the case.

Thus if they caught you on such a network you could state you didn't have that file in theory...

Your point is a good one and well made, however I fundamentally disagree with it.
See my PM, it would obviously depend on the wording and intent of the legislation in the particular country.
