They're backing down because they are losing the battle. File sharing is here to stay, so the record companies and artists better soon get with the program instead of trying to fight it. I'm not in the US, but I follow this closely, and from what I can see RIAA doesn't have a leg to stand on - but on the down side, people get all freaked out and bow to Big Red. Any good lawyer should be able to get it thrown out as there are so many holes in the DMCA.
By the way, you notice that the only artists that are really bitching about this suck. You'd have to pay me to download or listen to LL Cool J or Metallica. Fingernails on a chalkboard make better music than these no talents.
