I would be extremely impressed if they could actually 'kill' it. But I'm doubtful.
I found a semi hidden link to properly delete your account on facebook off some site, I'm sure it even said it'll be deleted on the screen and non recoverable. I hope this was right...
That link does "delete" your account instead of just deactivating it. It's what I used it when I killed my account after deciding I had nothing to do there. However, as it is the case with most major services on the Internet these days, it doesn't really remove your data from the server (or backups) for good.

They could but as soon as arrests and fines happen a lot of people would stop. I doubt they would sit by and do nothing losing profits.
