Surely it makes no sense to go after the site using the embedding if they really want there content removing?
I think the porn tube sites are doing this very thing to escape vulnerability. If you notice, there are numerous hosting sites, and numerous linking sites, making not any one of them in particular a valuable target. If I recall, Perfect 10 is a porn producer so that might have made a major impact in the current organization.
Pretty soon it's going to be illegal to think about copyrighted content.
By this logic any images from the movies you remember is a tertiary infringement?
see, the flaw with your statement is that you are assuming that the MPAA operates based on what "makes sense".
thats another problem. judges and lawyers that dont even understand half of the argument. so judges just make a decision based on some skewed, invalid analogy. The case has been plagued by confusion over the difference between hosting a video and embedding a video hosted by someone else.
