The bottleneck there is the ability of users to give out the file, not your ability to receive it.
This is good news for me, Im a comcast user too. All I really care about is getting my upload speed faster, 256 just doesnt cut it.
Im gonna post a question on their forums to make sure you wont get caught.

This is what someone replyed to me at Comcast's forums:
When you register the modem with comcast they will push a config file to your modem... This is the "cap" (most places its 3.3m down and 256k up).. So what "cap" that's in your modem now is unimportant...
