Everyone who knows what Usenet is and downloads binaries from it regularly, is familiar with the main problem of this network - it's not censored and nobody verifies the files posted to it. Nobody cares about verifying Nzb files that will be uploaded to Usenet daily. This leads to such problems like fake, password protected, virus infected or incomplete archives. Classical search engines like Binsearch, NZBClub or NZBIndex provide a Usenet search and just index the Nzbs without real check of its quality. It’s been a while since we haven’t heard of Newzbin and the industry’s struggle to block access to this portal. Of course, we remember how the Kingdom’s ISP BT was forced by court order to block access to the file-sharing portal “thanks” to the MPA’s decision to file suit – representing giants like Warner Bros, Fox, Disney and Paramount Pictures.

Although the ink is barely dry on the order forcing ISP BT to block the Newzbin2 Usenet indexing site, the MPA isn’t wasting its momentum. Through its UK proxy the Federation Against Copyright Theft, Hollywood has taken another Usenet indexing site offline, and for its owner the situation doesn’t look good.

Dutch anti-piracy outfit BREIN has won its landmark court case against News-Service.com, one of the leading Usenet providers. The Amsterdam court ruled that the Usenet provider, which offers its network to Binverse and Usenext among others, has to delete all infringing content from its servers. This decision is similar to the one that effectively shut down the BitTorrent site Mininova, and it could mean the end of one of the leading providers of Usenet access.

The operators of Usenet indexing site Newzbin2 have introduced measures to circumvent court-ordered web-blocking measures designed to render the site inoperable in the UK. Site staff aren’t revealing how the stand-alone software client works but some basic network packet analysis shows that it defeats ISP BT’s Cleanfeed censorship system by using a handful of techniques including encryption.

In the copyright case brought against Usenet provider in the United States by Perfect 10, Judge Marilyn L. Huff of California's US District Court granted Giganews' request for an extension to review the case against them. Usenet newsgroups providers have long enjoyed safe harbor thanks to the DMCA (Digital Millennium Copyright Act), as do all ISPs in the United States. Will this lawsuit rock the foundations of the DMCA, or will Giganews emerge victorious?

While the government and its communications watchdog run around trying to find out if effective site blocking is feasible, Newzbin2 have just taken steps to neutralize it before it even happens.
